For the purposes of this Policy, the following terms shall be defined as follows, namely:
- "Information Officer" means Nadia Venter;
- "Personal Information" means ‘personal information’ as that term is defined in POPIA, being: information relating to an identifiable, living, natural person, and where it is applicable, an identifiable, existing juristic person, including, but not limited to:
- information relating to the race, gender, sex, pregnancy, marital status, national, ethnic or social origin, colour, sexual orientation, age, physical or mental health, well-being, disability, religion, conscience, belief, culture, language and birth of the person;
- information relating to the education or the medical, financial, criminal or employment history of the person;
- any identifying number, symbol, e-mail address, physical address, telephone number, location information, online identifier or other particular assignment to the person;
- the biometric information of the person;
- the personal opinions, views or preferences of the person;
- correspondence sent by the person that is implicitly or explicitly of a private or confidential nature or further correspondence that would reveal the contents of the original correspondence;
- the views or opinions of another individual about the person; and
- the name of the person if it appears with other personal information relating to the person or if the disclosure of the name itself would reveal information about the person.
- "POPIA" means the Protection of Personal Information Act 4 or 2013, as amended;
- "Processing" means ‘processing’ as that term is defined in POPIA, being:
any operation or activity or any set of operations, whether or not by automatic means, concerning personal information, including—
- the collection, receipt, recording, organisation, collation, storage, updating or modification, retrieval, alteration, consultation or use;
- dissemination by means of transmission, distribution or making available in any other form; or
- merging, linking, as well as restriction, degradation, erasure or destruction of information;
- "Website" means the website of Byte Orbit currently hosted at Byteorbit.com, as Byte Orbit may choose to use from time to time;
- "You", "Your" or "User" means any person who accesses and uses the Website for any reason;
- "Us", "Our" or "We" means Byte Orbit (Pty) Ltd;
- "Job Application" means You completing the application form on the Website and submitting Your CV or Portfolio to Us for processing;
- "Test Pilot" means registering with Byte Orbit to participate in product testing; and
- "Contact Form" means the input form on the Website where You submit an enquiry.

Accountability
- Byte Orbit is responsible for Personal Information under our control and has designated the Information Officer as our information officer, accountable for Byte Orbit’s compliance with the POPIA. Comments and questions regarding this Privacy Notice or its administration should be forwarded to the Information Officer.
- Byte Orbit is responsible for Personal Information in our possession or custody, including information that has been transferred to a third party for Processing. Byte Orbit uses contractual or other means to provide a comparable level of protection while a third party is processing such information.
- Byte Orbit has implemented policies and practices to give effect to the principles of POPIA, including:
- procedures to protect Personal Information;
- procedures to receive and respond to enquiries and complaints;
- training staff and communicating information to staff about Byte Orbit’s policies and practices; and
- provision of materials to explain Byte Orbit’s policy and procedures.

- Whilst Byte Orbit will make all efforts to ensure the integrity and accuracy of Your Personal Information, this may not at all times be possible. By agreeing to this Privacy Notice, You accept the responsibility for the accuracy of the Personal Information You provide to Byte Orbit and for keeping Your Personal Information up to date, and You undertake to inform Byte Orbit of any changes to Your Personal Information.

Subject to paragraph 6.2, we will only use the Personal Information You provide for the purpose of:
- replying to Your query submitted via the Contact form, using the Personal Information You provided ;
- Processing Your registration as a Test Pilot, using the Personal Information You provided in the registration process. ; and
- Processing Your job application using the Personal Information that You provided.
- Should the specific purpose for which Your Personal Information is collected differ from that specified in paragraph 6.1, such purpose will be communicated to You when the information is requested.

Processing Limitations - Limiting Collection & Processing
- Byte Orbit will limit the collection of Personal Information to that which is necessary for the purposes that we have identified. Such information will be collected by fair and lawful means.
- Byte Orbit will not collect Personal Information indiscriminately or in a misleading manner. Both the amount and the type of information collected will be limited to that which is necessary to fulfil the purposes identified.
- Personal Information will not be used or disclosed for purposes other than those for which it was collected, except with the consent of the individual or as required by law. Personal information will be retained only as long as necessary to fulfil those purposes.
- Byte Orbit will only Process Personal Information for a purpose consistent with the purpose for which it is collected, and to which You have consented.

Processing Limitations - Retention and deletion of Your Personal Information
- Byte Orbit will not retain Your Personal Information longer than is necessary to achieve the purpose for which the information was initially collected, or subsequently Processed unless we are required to do so by law.
- The following retention periods apply:
- in the case of Your submission via the Contact Form, Your submission is directed to inbox@byteorbit.com. This mailbox is monitored by a controlled group of employees and emails to and from this mailbox are retained indefinitely;
- in the case of Test Pilots, Your information is securely stored and will be retained until You request its deletion. We will only use this Personal Information for purposes of assessing Your suitability for future test pilot opportunities; and
- in the case of Job Applications, Your Personal Information is securely stored and will be retained until You request its deletion. We will only use this Personal Information for the purposes of assessing Your suitability for future job opportunities
- If You request it, Byte Orbit will delete or anonymise Your Personal Information so that it no longer identifies You, unless we are legally permitted or required to maintain such Personal Information, including situations such as the following:
- where Byte Orbit is required to retain the Personal Information for our legal, tax, audit, and accounting obligations, Byte Orbit will retain the necessary Personal Information for the period required by applicable law; or,
- where necessary for Byte Orbit’s legitimate business interests such as fraud prevention or to maintain the legitimacy of the services offered by Byte Orbit.

- recognised legal or regulatory bodies.
- We will only share Your Personal Information in the following circumstances:
- if We reasonably believe that it is necessary to comply with a law, regulation, public policy or legal request (e.g. to assist in matters of public interest or safety or in connection with actual or proposed litigation);
- to provide the service You have requested or authorised;
- to maintain the security of Our products and services; or
- to protect Our or Your rights and to protect our property.

Anonymous Data Collection
- Byte Orbit may use tools to collect information about the use of the Website. The technology is not able to identify individual users but allows Byte Orbit to collect usage statistics.
- Byte Orbit may utilise perpetual, temporary or session cookies to keep track of Your browsing habits. A cookie is a small file that is placed on Your hard drive to keep a record of Your interaction with the Website and facilitate user convenience.
